       A mass tort is a civil action involving numerous plaintiffs pursuing a claim against one or more corporate defendants. The term “mass tort” is often used interchangeably with “class action”, but they are not the same. A class action suit is a type of mass tort. Most mass tort claims are made because a large number of consumers have been injured by a defective drug or product. By pooling together, the consumers are able to present a far more capable challenge to the offending corporation than they would be able to alone.

 

The following products are currently in the news due to mass tort action against the companies that produce them.

 

IVC Filtersare devices used to protect against blood clots. Several serious problems have been identified by the FDA.

Zimmer Persona Knee Implants– have caused enough problems in some patients that they need to have them replaced.

Xarelto/Pradaxa/Eliquis– are anticoagulants that put patients at risk of internal bleeding, stroke, or even death.

Nvokana/Invokamet– are diabetes medications. The FDA has warned that they may lead to an increased risk of kidney failure, heart attack, and ketoacidosis.

Zofran- is an anti-nausea drug that was illegally marketed to pregnant women, causing birth defects.

Talccompanies are currently facing thousands of lawsuits over the talc/cancer link.

Opioid– addiction is an epidemic and the manufacturers of these pharmaceuticals should be held responsible.

Roundup– is a common herbicide. Evidence is increasingly linking Roundup to cancer.
